Terms of Service

YachtsDirect CRM is an internal, invitation-only application made available to YachtsDirect employees, brokers, and other personnel (“Authorized Users”). Accounts are created when an administrator sends an invitation to your work email address. Self-service sign-up is disabled.

You are responsible for safeguarding your sign-in credentials and for all activity that occurs under your account. You must notify us immediately at tech@yachtsdirect.com if you suspect unauthorized access.

You agree not to use the Service to:

• Violate any law, regulation, or third-party right, including privacy and intellectual-property rights.
• Send unsolicited commercial messages, spam, or material that is unlawful, harassing, or fraudulent.
• Attempt to access accounts, data, or features that you are not authorized to access.
• Probe, scan, or test the vulnerability of the Service or any related system without our prior written consent.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where this restriction is prohibited by applicable law.
• Use the Service to build a competing product or to benchmark its availability or performance for a third party.

You retain ownership of the records, notes, and other content you enter into the Service (“Customer Data”). YachtsDirect owns Customer Data that has been entered on behalf of the business by Authorized Users in the course of their work.

You are responsible for ensuring that any Customer Data you submit complies with applicable law and that you have the rights necessary to submit it. You will not enter sensitive categories of personal data (such as government-issued identifiers, payment-card numbers, or health information) into the Service unless explicitly required for a documented business purpose.

The Service connects with third-party services, including Google Calendar and Gmail, on the user’s authorization. Your use of those services is governed by the third party’s terms and privacy policies. YachtsDirect is not responsible for the availability, accuracy, or security of any third-party service. You can revoke an integration at any time from Settings → Integrations.

Our handling of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.

We may suspend or terminate your access to the Service at any time, with or without notice, for any conduct that we believe violates these Terms or is otherwise harmful to YachtsDirect, its personnel, or its customers.

When your employment or engagement with YachtsDirect ends, your access to the Service will be revoked. Records you created will be retained by YachtsDirect in accordance with our Privacy Policy.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, YachtsDirect disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, in no event will YachtsDirect or its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of the page and, for material changes, notify Authorized Users by email or in-application notice. Continued use of the Service after a change constitutes acceptance of the revised Terms.
